Veterans Commission Resolution No. 07-02
WHEREAS,
the Missouri Veterans Commission is a public governmental body as
defined in Chapter 610 RSMo; and
WHEREAS,
Section 610.023.1, RSMo, provides that a public governmental body
is to appoint a custodian to maintain that body’s records
and the identity and location of the custodian is to be made available
upon request; and
WHEREAS,
Section 610.026, RSMo, sets forth that a public governmental body
shall provide access to and, upon request, furnish copies of public
records; and
WHEREAS,
Section 610.028.2, RSMo, provides that a public governmental body
shall provide a reasonable written policy in compliance with sections
610.010 to 610.030, RSMo, commonly referred to as the Sunshine Law,
regarding the release of information on any meeting, record or vote;
and
WHEREAS,
The Missouri Veterans Commission also maintains records that are
not public records, including but not limited to clinical records
of the residents of the Missouri Veterans Homes, and the Commission
desires to provide procedures for access to such records to such
residents and their legal representatives.
NOW,
THEREFORE, BE IT RESOLVED:
1. That
the Executive Director for the Missouri Veterans Commission be and
hereby is appointed custodian of the records of the Missouri Veterans
Commission and that such custodian is located at 205 Jefferson Street,
12th Floor, PO Drawer 147, Jefferson City, Missouri, 65102. The
Executive Director of the Commission may appoint deputy custodians
as necessary, for the efficient operations of the Commission.
2. That
all requests for records shall be in writing, and that said custodian
shall respond to all such written requests and notify the individual
or organization within 3 business days from the date the request
was received by the custodian whether access is granted or denied.
Provided, however, in connection with requests for clinical records,
residents of Missouri Veterans Homes and their legal representatives,
have the right upon oral or written request to access all current
clinical records pertaining to such residents (or their legal representative)
within 24 hours (excluding weekends and holidays). After receipt
of such records for review, the resident or his or her legal representative
may request a copy of all or any portion of the current clinical
records pertaining to such resident, and said records will be provided
by the custodian to the resident or legal representative, as required
by law, following the receipt of the written request for such records.
3. That
the fees to be charged for access to or furnishing copies of records
shall be as hereinafter provided: 10 cents per page for standard
paper copies nine by fourteen inches or smaller, plus an hourly
fee for duplicating time not to exceed the average hourly rate of
pay for clerical staff of the public governmental body (currently
$12.32). Research time will be billed at actual cost. Fees for providing
access to public records maintained on computer facilities, recording
tapes or disks, videotapes or films, pictures, maps, slides, graphics,
illustrations or similar audio or visual items or devices, and for
paper copies larger than nine by fourteen inches shall include the
cost of copies, staff time, which shall not exceed the average hourly
rate of pay for staff of the Missouri Veterans Commission required
for making copies and programming, if necessary, and the cost of
the disk, tape, or other medium used for the duplication. Fees for
maps, blueprints, or plats that require special expertise to duplicate
will include the actual rate of compensation for the trained personnel
required to duplicate such maps, blueprints, or plats. Fees for
color copies shall carry a surcharge based upon the actual cost
differential between standard and color copies. If programming is
required beyond the customary and usual level to comply with a request
for records or information, the fees for compliance will include
the actual costs of such programming.
4. That
the fees may be waived by the custodian when it is in the public
interest to do so. In addition, if the amount of the fee is nominal,
such fees may be waived.
5. That
it is the public policy of Missouri Veterans Commission that meetings,
records and votes of this body shall be open to the public except
to the extent of any applicable provision of Section 610.021 RSMo,
and as otherwise authorized or required by law.
6. That
Missouri Veterans Commission shall comply with sections 610.010
to 610.030, RSMo, as now existing or hereafter amended.
7. That
this policy shall supersede the Missouri Veterans Commission policy
set forth in the Missouri Veterans Commission Administrative Policy
Manual at Section A-5 etc. and all prior Missouri Veterans Commission
policies and procedures regarding the release of information on
any meeting, record or vote.
